2. General terms of use
Accessing and using this website makes you a user and means that, from that moment, you accept the General Terms of Use set out here. These terms apply regardless of any General Terms of Contract that may be mandatory in each case.
www.latabernadelherrero.es gives you access to information, services, programs and data (hereinafter, “the contents”) belonging to the group or its licensors. You are responsible for the use you make of the website. That responsibility also covers any registration that may be required to access certain services or contents: you undertake to provide truthful and lawful information and, if you are given a password, to use it diligently and keep it confidential.
You undertake to make appropriate use of the contents and services and, by way of example but not limitation, not to use them to:
- Engage in unlawful or illegal activities, or activities contrary to good faith and public order.
- Spread content or propaganda that is racist, xenophobic, illegally pornographic, that glorifies terrorism or that violates human rights.
- Cause damage to the physical or logical systems of the group, its suppliers or third parties, or introduce or spread computer viruses or any other systems capable of causing such damage.
- Attempt to access other users' email accounts and, where applicable, use them or modify or tamper with their messages.
The group reserves the right to remove any comments and contributions that violate the dignity of the person, that are discriminatory, xenophobic, racist or pornographic, that harm young people or children, public order or public safety, or that in its opinion are not suitable for publication. In any case, the group shall not be liable for the opinions expressed by users through forums, chats or other participation tools.
3. Intellectual and industrial property
The group, on its own account or as assignee, holds all intellectual and industrial property rights to this website and to the elements it contains (by way of example: images, sound, audio, video, software or texts; trademarks or logos, colour combinations, structure and design, selection of materials used and the computer programs needed for its operation, access and use), whether owned by the group or by its licensors. All rights reserved.
Under Articles 8 and 32.1, second paragraph, of the Spanish Intellectual Property Law, the reproduction, distribution and public communication, including making available, of all or part of the contents of this website for commercial purposes, in any medium and by any technical means, without our authorisation, is expressly prohibited.
You undertake to respect these rights. You may view the elements of the website and even print, copy and store them on your computer's hard drive or on any other physical medium, provided that it is solely and exclusively for your personal and private use. You must not remove, alter, circumvent or tamper with any protection device or security system installed on the group's pages.
4. IP address and server log
The servers of this website may automatically detect the IP address and domain name you use. An IP address is a number automatically assigned to a computer when it connects to the Internet. All this information is recorded in the duly registered server log, which allows the data to be processed later in order to obtain purely statistical and security measurements: number of page impressions, number of visits to the web services, order of visits, access point, and so on.
Likewise, when you send the contact form we store the IP address and the browser you send it from as an anti-fraud and anti-spam measure. You can find details of this processing, and of the processing we will carry out through the booking platform, in the privacy policy and the cookie policy.
5. Disclaimer of warranties and liability
The group shall not be liable, under any circumstances, for damage or loss of any kind that may arise from, by way of example: errors or omissions in the contents, unavailability of the website, or the transmission of viruses or malicious or harmful programs in the contents, despite having taken all the technological measures necessary to prevent it.
The group reserves the right to make, without prior notice, any changes it considers appropriate to its website, and may change, remove or add both the contents and services provided through it and the way in which they are presented or located.
6. Links to other websites
If www.latabernadelherrero.es includes links or hyperlinks to other Internet sites —such as the group's social media profiles—, the group has no control whatsoever over those sites or their contents. Under no circumstances shall it be liable for the contents of a link belonging to a third-party website, nor does it guarantee the technical availability, quality, reliability, accuracy, completeness, truthfulness, validity or constitutionality of any material or information contained in such hyperlinks or other Internet sites. Likewise, the inclusion of these external links does not imply any kind of association, merger or participation with the linked entities.
7. Withdrawal of access and breaches
The group reserves the right to deny or withdraw access to the website and to the services offered, without prior notice and on its own initiative or at the request of a third party, to any users who breach these General Terms of Use.
The group will also pursue any breach of these terms and any misuse of its website, exercising all civil and criminal actions to which it may be entitled by law.
8. Changes to these terms and duration
The group may change the terms set out here at any time; changes will be duly published as they appear on this page. These terms remain in force for as long as they are displayed, until they are replaced by other duly published terms.
9. Information security
This website uses information security techniques generally accepted in the industry, such as firewalls, access control procedures and cryptographic mechanisms, in order to prevent unauthorised access to data. To achieve these aims, you accept that the provider may obtain the data needed to authenticate the corresponding access controls.
Any contracting process, or any process involving the entry of special categories of personal data —for example, health data such as the food allergies and intolerances you may tell us about when booking— is always transmitted using a secure communication protocol (HTTPS), so that no third party can access the information transmitted electronically.
10. Complaints
All our establishments have official complaint forms (hojas de reclamación) available to consumers and users. You can also send us any complaint by writing to latabernaoficina@gmail.com, calling 942 05 54 19 or by post to Calle El Castro, 24 - Piso 1A, 39011 Santander (Cantabria); we will reply as soon as possible.
11. Applicable law and jurisdiction
The relationship between the group and you, as a user, is governed by the Spanish legislation in force. Any dispute shall be submitted to the competent courts and tribunals in accordance with the law, without prejudice to the jurisdiction that consumer and user protection legislation grants in your favour.
